Mediation and Mediators

MEDIATION IS A FAIR AND EFFICIENT PROCESS TO HELP YOU RESOLVE CONFLICT. A mediator is a third-party neutral trained to assist parties in settling disputes. He or she has no authority to decide who wins or gets what. Mediation is both cost effective and timely. Many mediated settlements are completed in one meeting. Legal representation is permitted in all cases but is not required. The mediator - either lawyer or non-lawyer - cannot ethically provide legal advice since he or she is neutral. An increasing number of people and companies are going to mediation before going to court. Some may even go to mediation before going to a lawyer. Mediators can help inside a company or between a company and its customers or suppliers. Mediators are helpful in family disputes, divorce and child custody cases and in almost any kind of conflict. Choose your mediator carefully. Before hiring a mediator, talk to him or her by phone. Look at the mediator's experience and fees as well as her experience outside of mediation. Check the mediator's training. Where was she trained and how much training? A mediator may be credentialed, but it is not required. If credentialed, by whom? Keep in mind that the other parties must agree to use the same mediator, so you may want to select the names of two or three mediators for consideration.
